It is long overdue,\u201d<\/em> <em>\u201cLegalise love #9103,\u201d \u201c9103 YES to civil partnerships.\u201d<\/em>\u00a0<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-at-the-first-opportunity-to-march-for-lgbtq-rights-since-the-beginning-of-the-full-scale-invasion-the-participants-of-kyiv-pride-2024-civilians-and-soldiers-alike-responded-to-the-new-political-reality-in-ukraine-in-march-2023-a-bill-that-aims-to-legalise-both-opposite-sex-and-same-sex-civil-unions-was-introduced-to-the-ukrainian-parliament\"><strong>At the first opportunity to march for LGBTQ+ rights since the beginning of the full-scale invasion, the participants of Kyiv Pride 2024, civilians and soldiers alike, responded to the new political reality in Ukraine: in March 2023, a bill that aims to legalise both opposite-sex and same-sex civil unions was introduced to the Ukrainian Parliament.\u00a0<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-noticing-that-ukraine-unlike-its-eastern-european-neighbours-such-as-poland-romania-belarus-and-moldova-is-in-the-active-process-of-negotiating-legislative-changes-that-could-significantly-improve-access-to-family-rights-for-lgbtq-persons-bang-bang-decided-to-track-the-way-this-bill-has-come-about\"><strong>Noticing that Ukraine, unlike its Eastern European neighbours such as Poland, Romania, Belarus, and Moldova, is in the active process of negotiating legislative changes that could significantly improve access to family rights for LGBTQ+ persons, Bang Bang decided to track the way this bill has come about.&nbsp;&nbsp;<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-with-the-help-of-a-member-of-the-union-of-the-lgbt-military-an-mp-from-the-ukrainian-parliament-and-an-lgbtq-activist-from-moldova-we-answer-why-this-type-of-legislation-is-crucial-what-it-means-for-a-country-in-the-process-of-european-integration-and-what-moldova-sharing-similar-political-aspirations-of-eu-accession-can-learn-from-ukraine-s-example\"><strong>With the help of a member of the Union of the LGBT Military, an MP from the Ukrainian Parliament, and an LGBTQ+ activist from Moldova, we answer why this type of legislation is crucial, what it means for a country in the process of European integration, and what Moldova, sharing similar political aspirations of EU accession, can learn from Ukraine\u2019s example.&nbsp;<\/strong><\/h2>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\" id=\"h-petition-in-support-of-same-sex-marriage\">Petition in support of same-sex marriage<\/h2>\n\n\n\n<p>In 2022, half a year into the Russian full-scale invasion, an <a href=\"https:\/\/petition.president.gov.ua\/petition\/144562\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">online petition was submitted to the President of Ukraine<\/mark><\/strong><\/a>, demanding the legalisation of same-sex marriage. Its description was straight to the point:<em> \u201cAt this time, every day can be the last. Let people of the same sex have the opportunity to start a family and have an official document that confirms it. They are in need of the same rights as traditional couples.\u201d<\/em>&nbsp;<\/p>\n\n\n\n<p>Once the petition gained the required 25,000 signatures, it was considered by President Zelensky. In his response, Zelensky noted that, to legalize same-sex marriage in Ukraine, it is necessary to change the definition of marriage as <em>\u201cbased on the free consent of a woman and a man\u201d<\/em> in Article 51 of the Constitution. Since constitutional amendments are impossible under martial law, Zelensky added, the Ukrainian government is examining another option: the legalisation of civil partnerships.&nbsp;&nbsp;<\/p>\n\n\n<div class=\"wp-block-image is-style-default\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXdOiqvVIq-5mwzARjKTAdRqXm7fmIrLPVLP871wMvGKHFItaQapbVpIeXxOwqp1TDRmzC1QosJZfp00nFWn9JCek72P4MW8jpLIfAvzBFqMovBA7_5KqEqaDatHT098HXgRaZyjGn_wQpbMhP9Qd20PgoPS?key=pNFL91ap4lrJ0FuYYJ6pCg\" alt=\"\" style=\"width:597px;height:auto\"\/><figcaption class=\"wp-element-caption\"><em>Participants of this year\u2019s Kyiv Pride with protest signs. Bill \u21169103, \u201cOn the Institution of Civil Partnerships,\u201d was introduced to the Ukrainian parliament in March 2023 after 9 months of preparation. It was initiated by lawmaker Inna Sovsun, representing the Holos party, and endorsed by 17 other MPs from the Holos and Servant of the People parties.&nbsp;<\/p>\n\n\n\n<p>According to the bill\u2019s provisions, it aims to legalise both opposite-sex and same-sex civil partnerships which would equate the status of a partner to that of the closest family member. This would grant civil partners the same legal rights as in marriage, with the exception of child adoption.&nbsp;<\/p>\n\n\n\n<p>Although the bill has not yet been passed in the relevant committee, without whose approval it cannot make it to the parliamentary floor, it has received positive assessment from at least 5 other committees. <a href=\"https:\/\/kyivindependent.com\/verkhovna-rada-committee-supports-draft-bill-on-civil-partnerships-for-same-sex-couples\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">The latest committee to back the bill<\/mark><\/strong><\/a>, in August 2024, was the Committee on Public Health, Medical Assistance, and Health Insurance, which recommended it for adoption in the first reading in parliament.&nbsp;<\/p>\n\n\n\n<p>A number of Ukrainian ministries <strong><a href=\"https:\/\/www.kmu.gov.ua\/bills\/proekt-zakonu-pro-institut-reestrovanikh-partnerstv\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">expressed their moderate endorsement of the bill<\/mark><\/a><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">: <\/mark><a href=\"https:\/\/suspilne.media\/culture\/597145-minoboroni-ta-minust-pidtrimuut-zakonoproekt-pro-reestrovani-partnerstva\/\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">the Ministry of Justice<\/mark><\/a><\/strong>, the Ministry of Finance, and the Ministry of Social Policy. Despite initial resistance and claims that the number of LGBTQ+ soldiers in the Ukrainian Armed Forces cannot be verified, the Ministry of Defence <a href=\"https:\/\/rainbowmap.ilga-europe.org\/countries\/ukraine\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">changed its position<\/mark><\/strong><\/a> and, in October 2023, declared its support for the bill.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\" id=\"h-lgbtq-rights-in-the-context-of-war\">LGBTQ+ rights in the context of war<\/h2>\n\n\n\n<p>In his <a href=\"https:\/\/ombudsman.gov.ua\/report-2022\/rivni-prava\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">annual report from March 2022<\/mark><\/strong><\/a>, the Ukrainian Parliament Commissioner for Human Rights, Dmytro Lubinets, criticised the absence of legal recognition of same-sex relationships in Ukraine. Framing the need to legalise same-sex civil partnerships as an \u201cacute\u201d issue, Lubinets highlighted how the Russian full-scale invasion contributed to the urgency of this legislative measure: <em>\u201cIn the conditions of war, representatives of the LGBTQ+ community serve in the Armed Forces, the Territorial Defence Forces, etc., and do not have the same opportunities as heterosexual persons to legalise their relationships and acquire mutual rights and obligations.\u201d<\/em><\/p>\n\n\n\n<p><strong>Anna<\/strong>, a pansexual woman serving in the 47th Mechanised Brigade of the Ukrainian Army as an evacuation medic, confirms the report\u2019s conclusions: <em>\u201cWhy is this bill really important to us now? Because marriage and civil partnership options give you the opportunity to be responsible for another person\u2019s life in extreme situations.\u201d&nbsp;<\/em><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXdCi1HWO4WA-gMMYLqbGPNT8wWgy5b7hepu3VFYjfyaJqTu_haAxOoKDYBgZXz5BCXCt2f2-mW5wxyHZqMnHp_Bzheb4itTnI0QhBXAH0K7nKCs2dqkLr8NWkUn7koO2glAMejqSlWnRhhS9UUt7dmXeLig?key=pNFL91ap4lrJ0FuYYJ6pCg\" alt=\"\" style=\"width:607px;height:auto\"\/><figcaption class=\"wp-element-caption\"><em>Anna (Kazhan), evacuation medic in the Ukrainian Armed Forces. Photograph: Yurii Stefanyak.&nbsp;<\/em><\/figcaption><\/figure>\n<\/div>\n\n\n<p>In a conversation with <strong>Bang Bang<\/strong>, Anna does not hesitate to list the rights that same-sex couples could obtain with the legal recognition of their relationship: the right to decide on the scope of medical intervention if one\u2019s partner gets severely injured, the right to access the intensive medical care unit as the partner\u2019s closest relative, and, as tragic as it may be, the right to identify and claim the body of your loved one.<\/p>\n\n\n\n<p><em>\u201cFor the LGBTQ+ people, especially those who serve in the army, this bill is essential,\u201d <\/em>Anna repeats emphatically. Taking into account the initiative\u2019s advantages as well as its limitations, she later concedes: <em>\u201cI would say that same-sex marriages are even more essential, but, right now, there is no public discussion about those.\u201d<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\" id=\"h-queer-visibility-and-public-opinion-about-the-bill\">Queer visibility and public opinion about the bill<\/h2>\n\n\n\n<p>According to a <a href=\"https:\/\/www.kiis.com.ua\/?lang=eng&amp;cat=reports&amp;id=1417&amp;page=1\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\"><strong>recent all-Ukrainian public opinion survey<\/strong><\/mark><\/a> conducted by the Kyiv International Institute of Sociology in May-June 2024, 70% of Ukrainians believe that the LGBTQ+ community should have equal rights with the rest of Ukraine\u2019s citizens. As to the legalisation of same-sex civil partnerships, however, the percentage of respondents ready to support the measure drops to 28%, whereas 25% report having no preference, the survey shows.&nbsp;<\/p>\n\n\n\n<p>When asked about any possible changes in public attitude in Ukraine towards the LGBTQ+ community at the backdrop of the Russian invasion, Anna appears sceptical. Although some developments at the governmental level, such as the introduction of the bill \u21169103, seem to enjoy more support because of LGBTQ+ persons contributing to the military effort, there has been no dramatic shift towards tolerance in Ukrainian society as a whole, she claims.&nbsp;<\/p>\n\n\n\n<p>Still, just like the activists and soldiers who chose to demonstrate openly during this year\u2019s Kyiv Pride, Anna believes in the potential of queer visibility to combat ignorance, especially in historically conservative institutions such as the army. She explains, <em>\u201c<\/em><em>Being a part of the army is a great experience because I have the opportunity to communicate closely with people whom I would barely meet in real life \u2014 people who come from a social stratum that is not really concerned with European values. My decision to join the Ukrainian Armed Forces was, among other things, connected to the fact that I wanted to be that one LGBTQ+ person those people are going to know and see.\u201d<\/em><\/p>\n\n\n\n<p><em>\u201cWhen I try to talk to them, sometimes they change their point of view,\u201d<\/em> Anna recalls.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\" id=\"h-pressure-from-the-church-opposition-to-the-bill\">Pressure from the church: opposition to the bill<\/h2>\n\n\n\n<p>In June 2024, <a href=\"https:\/\/www.bbc.com\/news\/articles\/cd1140yv03po\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\"><strong>in a commentary to the BBC<\/strong><\/mark><\/a>, a member of the Committee on Legal Policy responsible for analysing the quality of the bill \u21169103 and either recommending it for inclusion in the parliamentary agenda or rejecting it, revealed that the majority of the committee opposes the legislation.&nbsp;<\/p>\n\n\n\n<p>Among the committee members\u2019 primary concerns, the BBC\u2019s source added, is the objection of the church and its followers to the bill.<em> \u201cYou understand very well that this law is of a socially resonant nature. Do we need some kind of public disturbance now?\u201d<\/em> Ivan Kalaur, an MP from the Servant of the People party, addressed his colleagues <strong><a href=\"https:\/\/kompravpol.rada.gov.ua\/uploads\/documents\/34629.pdf?fbclid=IwZXh0bgNhZW0CMTAAAR0hfomHyJXO5ikTId3dqmhhpc7FZscPPSYnBkIi6apiH6fggeOQ6y344IY_aem_wbnWfCJCTBzN6WzI582lJg\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\">during a committee hearing this June<\/mark><\/a><\/strong>.<\/p>\n\n\n\n<p>Meanwhile, <a href=\"https:\/\/risu.ua\/en\/ocu-synod-considers-draft-law-on-civil-partnerships-unacceptable_n138031\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\"><strong>the official statement<\/strong><\/mark><\/a> of the Synod of the Orthodox Church of Ukraine in which the Synod opposes the bill \u21169103, makes more references to the institution of marriage than to that of the civil partnership. When it does address same-sex civil unions, it describes them as an institution <em>\u201ccontrary to the natural law established by God\u201d<\/em> that <em>\u201cposes a threat to public morality, in particular to the moral and psychological health of children.\u201d&nbsp;<\/em><\/p>\n\n\n\n<p>The Synod does not elaborate further on its allegations, claiming to have instructed the head of the Orthodox Church of Ukraine to <em>\u201csend relevant letters\u201d<\/em> to the Ukrainian parliament, the President, and the government.&nbsp;<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXf05V7ukbwBkTMfGa3DCno-0o_rk5YQVIpUZX19e34dFTNc8bFSRRFhEV4bispShyUSYqa1j3jTK1I6T0FKpJdXVeunyVHYl8CRrJZIE1W2Cbq8PVRFoM9WsnQ_QFjNwBDseEWTZ8hGJG0fRWNHDMHyvy4N?key=pNFL91ap4lrJ0FuYYJ6pCg\" alt=\"\" style=\"width:587px;height:auto\"\/><figcaption class=\"wp-element-caption\"><em>Activists displaying the main slogan of the Equality March in Kyiv in 2019. In response to conservative critics, it affirms: \u201cFreedom is our tradition.\u201d Photograph: Reporters.&nbsp;<\/em><\/figcaption><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading has-text-align-center\" id=\"h-the-eu-approach-lgbtq-rights-are-human-rights\">The EU approach: LGBTQ+ rights are human rights<\/h2>\n\n\n\n<p><em>\u201cI have always believed in equal rights for the LGBTQ+ community,\u201d<\/em> comments lawmaker <strong>Inna Sovsun <\/strong>on her initiative. <em>\u201cIt is just that I decided now is the time to draft the bill because I saw how vulnerable LGBTQ+ soldiers are.\u201d<\/em><\/p>\n\n\n\n<p>In response to Bang Bang\u2019s question about the false narratives surrounding the subject of same-sex partnerships and how to counter them, Inna reiterates that LGBTQ+ rights are a part of the broader human rights framework: \u201c<em>Yes, this falls under the human rights agenda. It is not a promotion of, as Putin phrased this, <\/em><em>\u00ab<\/em><em>gay propaganda<\/em><em>\u00bb.<\/em><em> It is not to <\/em><em>\u00ab<\/em><em>make people gay<\/em><em>\u00bb.<\/em><em> Same-sex partnerships have to be legalised because there are people who are gay, and they, just like every other citizen, need protection. That is the EU approach, and that is how my team and I are framing it as well.\u201d<\/em><\/p>\n\n\n\n<p>Given that Ukraine, like Moldova, is in the process of accession negotiations with the EU, Inna makes sure to explain how legalising same-sex partnerships is consistent with the aim of EU integration. <em>\u201cThere are documents that state what sort of legislation Ukraine must develop and adopt in order to meet the criteria for EU membership. The civil partnership bill is not part of the required list of bills.\u201d<\/em> <em>\u201cHowever, in order to become part of the EU we have to meet the Copenhagen criteria,\u201d <\/em>Inna adds.&nbsp;<\/p>\n\n\n\n<p>The Copenhagen criteria are <a href=\"https:\/\/neighbourhood-enlargement.ec.europa.eu\/enlargement-policy\/glossary_en\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\"><strong>a set of formal standards<\/strong><\/mark><\/a> that determine whether a country is eligible to join the EU. By noting that the level of adherence to human rights, as outlined in the Copenhagen criteria, is measured by how well Ukraine implements Council of Europe regulations and the decisions of the European Court of Human Rights (ECHR), Inna emphasises that the lack of legal recognition for same-sex couples in Ukraine constitutes a violation of the European Convention of Human Rights.&nbsp;<\/p>\n\n\n\n<p>She cites the recent ruling of the ECHR in <em>Maymulakhin and Markiv v. Ukraine <\/em><a href=\"https:\/\/hudoc.echr.coe.int\/fre#%7B%22tabview%22:[%22document%22],%22itemid%22:[%22001-224984%22]%7D\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-cyan-blue-color\"><strong>which declared that<\/strong><\/mark><\/a> the Ukrainian state violated Andriy Maymulakhin\u2019s and Andriy Markiv\u2019s right to privacy and non-discrimination by refusing to recognise them as legal partners in 2014. <em>\u201cIt is a two-tier approach: adherence to the Copenhagen criteria is measured by the Council of Europe, and the Council of Europe has already stated that Ukraine is in violation of the European Convention on Human Rights because of this court decision.\u201d&nbsp;<\/em><\/p>\n\n\n\n<p><em>\u201cThis is something most people, politicians, and ministers in Ukraine still do not realise: we will never fully meet the Copenhagen criteria without doing something about the civil partnership legislation,\u201d<\/em> stresses Inna.&nbsp;<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXfAXtgnymjYU1lWgwVu66FA5Zk78RX46NjaFj9jPuqJ9KW1Znq5JXTNJl8SMXwxmrfWvm_uw_5hLYymDT9gMrKbqpuNgFtGNhBWiuXuVuhHcO0O-Z_DehHQllcWoX7jgnIag8VTjfynloFtaaDFRiA4y9Us?key=pNFL91ap4lrJ0FuYYJ6pCg\" alt=\"\" style=\"width:591px;height:auto\"\/><figcaption class=\"wp-element-caption\"><em>Inna Sovsun, People\u2019s Deputy in the Verkhovna Rada of Ukraine, Vice-Chair of the Holos Party, and Senior Lecturer in Political Science at the National University of Kyiv-Mohyla Academy. Photograph: World Movement for Democracy.&nbsp;<\/em><\/figcaption><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading has-text-align-center\" id=\"h-ukraine-s-bill-9103-an-example-for-moldova\">Ukraine\u2019s bill \u21169103: an example for Moldova<\/h2>\n\n\n\n<p>When asked about the potential impact of the legalisation of same-sex civil partnerships in Ukraine on its neighbouring states, especially those that share Ukraine\u2019s aspiration to join the EU, Inna responds: <em>\u201cI would say that when the Ukrainian parliament passes this bill, it will become clear that this is part of the <\/em><em>\u00ab<\/em><em>homework<\/em><em>\u00bb<\/em><em>, <\/em><em>or something that a country has to do to become an EU member state.
